Scottish Government releases Strategic Compensation Policy post adoption statement

The Scottish Government has released a new Strategic Environmental Assessment post adoption statement.

If finalised, the policy would be implemented through a Scottish Statutory Instrument (SSI), with associated guidance.

The new proposal builds on the previous Energy Act and takes into consideration the environmental impacts of plan or programme alternatives, with each option assessed against a range of objectives and geographical considerations.

The strategic assessment aims to limit the risk of major delays and maximise beneficial marine environmental measures, helping to promote biodiversity alongside offshore wind development.

The Scottish Government has stated that it is committed to delivering a balanced approach that supports offshore wind growth while protecting the marine environment. The aim is to implement this through a clear and transparent framework, while maintaining flexibility and reflecting consultation feedback that called for more detailed reforms.

It is important to note that when seeking to secure wider compensatory measures, the compensation hierarchy must be followed. This requirement will be included within the SSI.

Further guidance is expected to be released once the legislation has been passed.
